DRAFT, pending legal review

Version 0.9 (draft) · Effective date: not yet in effect: these are drafts and nothing is sold under them

If a lot or its photos infringe your copyright or trademark, report it through the contact page or “Report this lot” on the lot page (no account needed), and we will review it. Counterfeit and infringing goods are prohibited.

Copyright (DMCA) notices

A notice must include: your physical or electronic signature; the work you say is infringed; the lot page address and what on it infringes; your contact details; a statement that you believe in good faith the use is not authorised; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner (17 U.S.C. § 512(c)(3)).

Designated agent: to be registered with the U.S. Copyright Office before selling opens; the contact page will then give the agent’s name, postal address, phone number and email. Until then the Market lists nothing for sale; send notices through the contact page.

Trademark and counterfeit reports

Use “Report this lot” (no account needed) with the reason “Counterfeit” or “Infringes my copyright or trademark”, or send the lot address, your mark and registration number, and why the listing infringes through the contact page.

Counter-notices and repeat infringers

A seller whose lot was removed may send a counter-notice under 17 U.S.C. § 512(g). Accounts that repeatedly infringe are closed.
