Liquidation Market terms
DRAFT, pending legal review
- What the Market is. The Liquidation Market on liquidator.news is a venue run by WeldonPC where sellers list and sell their own goods to buyers. Liquidator.news is not the seller of any lot, does not own, inspect, appraise, hold or take goods on consignment, does not set prices, and is not an auctioneer, auction firm, liquidator, consignee or escrow agent. The contract of sale is between buyer and seller.
- Money. Buyers pay sellers directly. Liquidator.news never holds, receives, splits or forwards a buyer’s money and offers no wallet, stored balance or escrow. Sellers pay WeldonPC for their plan and success fees under the seller agreement.
- Listings are the sellers’ words. Lot descriptions, photos, conditions and claims come from sellers. As an online service, Liquidator.news is not the publisher or speaker of information provided by sellers or buyers (47 U.S.C. § 230); it screens listings and acts on reports, but does not verify every statement. Seller badges state only what was checked.
- Who may use it. You must be 18 or older and able to make a binding contract. One person or business per account unless the plan includes a helper login.
- Prohibited items are listed at /market/prohibited and are part of these terms.
- Fair dealing. Shill bidding (bidding on your own lots, or having anyone bid for you to raise the price) is banned, is checked automatically and leads to suspension; buyers affected by it are told before they pay and may cancel or buy at the last good-faith bid once that option opens (it opens before timed bidding does). Asking for payment outside the seller’s PayPal Goods & Services or checkout, fake urgency and fee avoidance are banned.
- Fees. Buyers pay no fees. Seller fees are in the fee schedule.
- Timed bids. A bid is an offer to buy at up to your maximum. The highest maximum wins at one increment above the next maximum (equal maximums: the earlier one). Bids at or after the end time are refused; a bid with less than two minutes left moves the end to two minutes after that bid. You review every bid before it is placed. Typo withdrawals: one per lot and three in 180 days, within 5 minutes of the bid, never in the last hour, and never for a bid that made you the high bidder or met the reserve; withdrawn bids stay in the bid history, marked withdrawn.
- Strikes and suspension. Not paying for a lot you won or bought, not answering a dispute within 3 business days (Monday to Friday, not counting federal holidays, Eastern time), or a confirmed report adds a strike. Three strikes in 12 months suspend the account. We may also warn, suspend or close an account for breaking these terms; you will see the reason in your account inbox. To ask for a review, use the contact page and quote your account email.
- Ending. You may close your account at any time on your account page. Sales already made stay between you and the other side.
- Limitation of liability. The Market is provided as is. To the extent the law allows, WeldonPC is not liable for goods, their condition, title, delivery or payment between buyers and sellers, and its total liability to you is limited to the fees you paid to WeldonPC in the 12 months before the claim.
- Law and venue. Ohio law applies. Dispute terms are pending legal review.
- Changes. These terms have a version and an effective date. We will show a new version before it applies to you, and you will be asked to accept it before your next bid, purchase, listing or report.
- Who runs it. The Liquidation Market is powered by WeldonPC.com.
