Seller agreement

DRAFT, pending legal review

Version 0.9 (draft) · Effective date: not yet in effect: these are drafts and nothing is sold under them

  1. You are the seller of record. You sell your own goods, or goods you are authorised to sell, directly to the buyer. You are responsible for any sales tax you must collect; each listing has a field for it. You set your own prices.
  2. Accepted payment methods. Buyers pay you only through your PayPal Goods & Services account or an https checkout of an accepted card processor that you supply. You may not ask for or accept Zelle, wire transfers, crypto, gift cards, “friends and family”, Cash App, Venmo, money orders or cash by mail for a Market sale.
  3. Plans. Starter $1.95/month or $19.50/year (5 live lots, up to 8 photos a lot once photo upload opens, 3% success fee). Pro $9.95/month or $99.50/year (50 live lots, up to 16 photos a lot once photo upload opens, 2.5% success fee). Business $29.95/month or $299.50/year (300 live lots, up to 24 photos a lot once photo upload opens, 2% success fee). Prices are plus any sales tax that applies. Plans renew until cancelled; cancelling takes one click and the plan runs to the end of the paid term. A change of plan starts when the term you already paid for ends; there is no proration.
  4. Success fee. On each sold lot: the plan’s percentage of the sold price, at least $0.25, never more than 10% of the price, at most $50.00 before any sales tax, plus any sales tax that applies to the fee. Never on shipping or tax. No fee if the lot is unsold, the reserve is not met or the sale is voided; a sale voided after its statement is credited on the next statement. Fees are billed monthly and due on the 15th.
  5. Non-payment of fees. Seven days after the due date new lots pause (live lots run to their close); forty-five days after, the account is suspended. If unpaid fees older than 7 days reach $100.00 (Starter), $250.00 (Pro) or $500.00 (Business) within a month, new lots wait until they are paid on your statement.
  6. Your warranties. Each lot is not prohibited, not recalled, not counterfeit, not stolen, and yours to sell; its description and condition are true. Data-bearing devices are wiped. You will follow any local going-out-of-business sale rules if you use that wording.
  7. Trustees, receivers and court sales. Bankruptcy, court, trustee or receivership wording needs an approved proof (case number, court and sale order) reviewed by Liquidator.news; lots then say what was reviewed and that it was not confirmed with the court.
  8. INFORM Consumers Act. If you sell new or unused goods at volume (200 sales and $5,000 in a 12-month period), federal law requires us to collect and verify your bank account, tax ID and contact details and to ask you to certify them every year. We stop new or unused listings at 80% of either threshold until this is done. Above $20,000 a year your name, address and contact details are shown to buyers. This data is encrypted at rest.
  9. Pickup and shipping. You give your pickup address (kept encrypted) and state pickup hours, removal and rigging responsibility and any insurance certificate requirement. The site shows the pickup address only to the buyer whose payment you confirmed. Arrange pickup through the messages on the sale page.
  10. Indemnity. You will cover WeldonPC for claims that arise from your goods, your listings or your dealings with buyers.
  11. Shill bidding by you or anyone for you is banned and leads to suspension; affected sales may be put on hold.
